Air miles and divorce

When North Carolina couples go through a divorce, they may reach a divorce settlement agreement that divides common marital assets, such as the family home, retirement accounts, cash and personal collections. However, couples who are going through a divorce may want to scrutinize if there are any other assets worth discussing, such as air miles. While this may not seem like an important asset, it can add up to hundreds or thousands of dollars in value.

How assets like reward points get divided in a divorce case can vary. First, a person should look at the terms and conditions of their rewards program as this private contract will be outside of the scope of the divorce court. Some small print in reward points' programs may indicate that the points are not transferable. If this is the case, the spouse who does not have his or her name listed on the rewards program should insist that a monetary value be assigned to them when determining how to divide the marital assets. This may not always be an easy task if travel programs do not assign a certain cash value for their points. Instead, an individual may have to calculate a rough conversion of the value of the points by seeing how many points it would take for a plane ticket and then using that figure in his or her calculations.

Another option may be to divide the points into two separate accounts, if the company permits this strategy. Although the company may impose fees for transferring the points, this may be a method that can avoid contention. Fees should be handled in a fair manner.
