Social media divorce mistakes

North Carolina residents who are divorcing may wonder about common mistakes that can complicate the process. With the invention of social media, divorce in the 21st century has changed dramatically. One way to avoid making mistakes is to be aware of the problems that can arise when exes post on social media during or after the divorce.

The first thing to be aware of is that social media is not really private. Facebook posts, Instagram pictures and tweets can all be used against the person who made them. People might think that it is okay to tweet about the divorce because they do not have many followers, but those tweets are available on the Internet to anyone who wants to look. Many people think that they can simply block the ex, but that does not stop them from creating a fake account or asking mutual friends to document the posts on their behalf. The only way to guarantee that a soon-to-be ex does not see divorce information on social media is not to post it.

Second, deleting posts made in the heat of anger may not help matters. That could be considered the destruction of evidence and could cause additional problems.

Third, other people's posts could be just as damaging as things posted by the divorcing spouse. Pictures posted by children are commonly used in child custody cases to argue that the custodial parent is unfit, especially if the child is doing something inappropriate like drinking.

If posts are already out there, a family law attorney may be able to help minimize the damage by providing context to negative posts or looking for similar ways to discredit the opposing party. It may also be possible to negotiate an out-of-court settlement to keep social media posts away from the judge.
