Types of adoption

Adopting a child is a big decision that some North Carolina families choose to make. However, there are many avenues that couples can take when deciding to add a child to the family.

Divorce, relocation and children

Parents in North Carolina may benefit from understanding more about how a divorce proceeding can be affected by child custody relocation laws. The parent who intends to relocate may be required to propose a new visitation schedule. Many times, these scenarios result in a majority of parenting time being limited to summer months, spring break and holiday breaks. Some states may require the parent who is relocating to provide a majority of the funds needed for traveling expenses. Other times, each parent may be ordered to pay 50 percent of the traveling costs.

When can a parent gain a temporary custody order?

If a child's home state is North Carolina, a judge may give a parent a temporary custody order if a substantial risk is present in the child's current situations. This could include risk of bodily injury or sexual abuse, and it can even include a risk that somebody may abduct or remove the child from the state. This temporary order can only last for a limited time until the court has a full custody hearing.

Two types of divorce offer different options

In North Carolina, there are essentially two types of divorce. In absolute divorce, both parties can remarry, and the marriage is terminated. In divorce from bed and board, the marriage is not ended, and neither spouse can remarry. The main reason for a spouse to choose the latter involves spousal support and abandonment.
