If you need to receive or pay child support, there are probably some questions you have. Here are some common questions and the answers you may be looking for.

What is the statute of limitations for child support?

This is an interesting question, because parents can owe back child support for payments they've missed. What's important to know is the cut-off times for child support. Usually, at least in North Carolina, child support payments stop once a child turns 18. However, there are some exceptions. For instance, if a child is still in school, they could continue until the child is 20.

If a parent owes back child support, the statute of limitations is 10 years from when the installment was due. A judgment can also be revived one time, allowing the statute of limitations to go another 10 years longer.

How are child support payment amounts determined?

There are a range of amounts that parents may pay based on their gross monthly incomes. The child support paid is typically a percentage of income and also covers some related expenses. The number of children a person needs to pay for will also alter the amount owed in child support.

Does not paying child support affect your right to see your child?

No, unless a judge has issued an order otherwise. Typically, these are two separate issues that will be kept separate, meaning a child should continue to see his or her parent unless the court agrees to different terms or arrangements. The court will issue an order for child support and could garnish the other parent's wages or other income.
