Dispute resolution can benefit anyone going through divorce

Going through a divorce is hard, but having to go to court to work out problems with your divorce can be worse. No one wants to spend all his or her time in a court room or risk having a judge make all the decisions about his or her finances or children's needs. There are alternative options to this, though, especially if you choose to go through dispute resolution processes.

Most divorces can be resolved through information negotiations between you and your spouse. Usually, you and your attorney will use alternative dispute resolution proceedings to work out an agreement or settlement without having to go to court. Sometimes, these proceedings can take place in court, too, depending on the arrangement.

Mediation is another process that is similar. However, with mediation, you have one mediator who has no bias toward either party. That mediator leads individuals to a solution that fits well in their situation.

Alternative dispute resolution proceedings can help you and your spouse work out conflicts about child custody or support, property division or other concerns. However, the benefit of ADR completely depends on if you and your spouse can still work together to resolve issues and to what degree you disagree about key points in your divorce.

Alternative dispute resolution is not as adversarial as a traditional court hearing, and this can encourage a settlement. This process is an opportunity to work out differences without a judge's input as well as to walk away without needing as many court dates or hearings. When you reach an agreement, the court will need to approve it to a degree, but most will be settled quickly.
