You can fight for your child after a parental abduction

If you're losing sleep over the fear that your child could be taken away by his or her other parent, then you need to look into your legal options. If you have evidence that the other parent isn't returning your child on time or is violating court orders, there may be options for you to prevent that parent from having visitations without you or others present. If the worst does come to pass, there are still some things you can do to bring your child home and prevent a recurrence in the future.

What can you do if a parent abducts a child?

With parental kidnapping, it's important for officials to intervene as soon as possible. Law enforcement may be one of the only ways to intervene, involving state and federal authorities. Parental abductions violate a number of state and federal laws, so the parent, when found, will likely face a number of charges. Parents have the option of hiring their own investigators to the case if they prefer to do so.

What happens after your child is returned home?

After your child is returned, you will want to take steps to prevent the same thing from happening again. If you had joint custody, you may be able to ask for sole custody or limited shared custody with supervision. If the case is serious enough, it's possible for the parent to lose his or her rights to the children completely.

Taking a child away without permission or refusing to return a child violates a custody order in most circumstances. Unless there is a serious risk to the child or parent's health, taking a child against custody orders is a crime.
