Important considerations when pursuing stepparent adoption

The beauty of a family is that it can take on a diversity of sizes and shapes and still be bound together with undying love. Throughout Greenville families exist within single parent households, in arrangements where grandkids live with their grandparents, in blended families created through remarriage, and many other permutations that link together people through blood and the law.

Families can grow through adoption and this family law blog has previously discussed some of the ways that individuals may open their homes to children who need forever parents. This post will discuss some of the issues that may come up when a stepparent seeks to adopt the children of their spouse.

Stepparent adoption can be available when the spouse of a child's parent wishes to create a legal relationship with the youth. Before the stepparent may do this, though, the child's noncustodial biological parent must either relinquish their rights to the child or otherwise have their rights to parenthood destroyed by a court of law. Getting a biological parent to agree to such a drastic legal move can be challenging and can thwart some stepparents' dreams of adopting their spouses' kids.

Having a court determine that a biological parent should no longer have parental rights over their child can also be quite difficult to achieve. A stepparent may have to demonstrate that the biological parent is unfit to be a parent or has abandoned the child in question in order to see the biological parent's rights terminated.

Stepparent adoptions can be rewarding when families are able to create legal bonds between their members that link them together for life. Problems can arise during the process, though, and some who choose to pursue this legal path may benefit from discussing their legal cases with family law attorneys who work in their communities.
